Legal Hotline Q&A of the Week

Question
Some of our agents have been asking about getting commissions wired directly from closers. They say that closing companies will wire the agent portion of funds directly to them. My understanding is that this is illegal. Don't proceeds from closing have to go to the firm? And then the firm pays the agent?
|
Answer
An escrow company may wire commission or compensation funds directly to a broker ONLY if the firm's DB has given the escrow company signed, written instruction, specific to the transaction, instructing escrow to pay funds directly to the broker. If DB gives those signed instructions to escrow, then escrow may pay broker directly. It should be noted that the instructions must be given based on an individual transaction. DB cannot give a generalized instruction that escrow should always pay a named broker's compensation directly to the broker. The instruction specific to each transaction should be retained in the firm's transaction folder for the transaction.
