Question
In Form 35, Paragraph 4b, Seller has not checked any of the boxes regarding delivery of the inspection report. Mutual Acceptance is achieved. After Buyer's home inspection and within Buyer's 5-day contingency period, Buyer delivers Form 35R, disapproving the inspection and terminating. After delivery of 35R, Listing Agent delivers Form 35C requesting a copy of the inspection report. What is Buyer's obligation at this point? Does Seller's option to deliver F35C and request the inspection report survive termination of the Agreement?

Answer
No. When buyer terminated the purchase agreement, buyer terminated seller's contractual right to demand delivery of the inspection report. Because the PSA was terminated prior to seller consenting to receive the report, buyer has no obligation to deliver the report.
