Question
Our team is getting ready to list a property and we are not sure if the Sellers will be exempt (Estate) or are required to fill out a seller disclosure statement. The property in question belonged to their deceased father. There was no formal probate process as the siblings are the direct heirs and all three will be signing as such. They have already completed and filed a lack of probate affidavit. Can you please advise as to whether they will be exempt from disclosure in this particular situation?

Answer
The fact that each heir will sign the deed conveying title must mean that title has already been conveyed to the heirs. That means that the property is no longer owned by the estate. Consequently, the sale is NOT exempt from the Seller Disclosure Act.
