Supporting Eastern Washington's Wildfire Recovery
Our hearts are with the individuals, families, and communities facing unimaginable loss and uncertainty as wildfires continue to impact Eastern Washington. We stand with everyone affected in Spokane, Stevens, and Lincoln counties — including those who have lost homes, been displaced, or are still awaiting news of their property and loved ones.
The REALTORS® Relief Foundation has issued a $500,000 disaster-relief grant to support eligible wildfire survivors with housing payments and other immediate needs. Those impacted can apply online or download an application through Spokane REALTORS®’ Wildfire Relief page.
Spokane REALTORS® has also compiled additional local resources, application guidance, required-documentation information, and recovery updates for those affected. If you or someone you know needs support, please explore the available resources.

Legal Hotline Q&A of the Week

Question
I am representing a seller. We are under contract and the buyer's agent delivered the 35R requesting repairs. My sellers responded with a counter on repairs. The buyer's agent then delivered their final response on Form 35R on Day 2 of their timeline, suggesting another solution. Before the end of Day 3, the buyer's agent REDELIVERED Form 35R with the acceptance box checked. The question is, can the buyer deliver their final response twice if they are within the inspection timelines? Are we still under contract and the inspection contingency now satisfied?

Answer
When the buyer countered seller's offer on day 2, buyer's counter was a rejection of seller's counteroffer which voids seller's counteroffer. When buyer attempted to "accept" seller's counteroffer on day 3, the seller's counteroffer no longer existed and thus, could not be "accepted". This means that at 9pm on day 3, buyer's inspection contingency was waived because at that point, buyer did not have a binding agreement with seller for concessions and buyer had also not terminated the agreement. At this point, as a matter of contract, buyer has no inspection contingency and no agreement with seller for seller to provide concessions.
If seller wants to revise the purchase agreement to include a requirement that seller will, in fact, provide the concessions included in the counteroffer that buyer attempted to accept, seller can do that. Seller is not obligated to do that. If the parties find themselves in a dispute they cannot resolve, broker should advise seller to seek legal counsel.
