Viral Stat Falls Short of the Facts

Question

I need clarification on a timing/entry issue under Form 35. Inspection period is 15 days. We are currently on Day 7. Initial home inspection completed. Client wants a handyman/general contractor to visit and provide cost estimates for several items listed on the inspection report that do not explicitly require a specialist. The listing agent says I must send an “additional time” notice and must include only the inspection items that specify a specialist in that notice. Is that correct? May we have a general contractor/handyman enter during the initial 15‑day inspection period, without sending any additional time/extension notice, to provide quotes for items that do not call for a specialist?

Answer

Buyer broker is correct. Form 35 allows buyer to bring any person who qualifies as a specialist into seller's home during both the initial inspection period and the additional inspection period. The contractor who will make the repairs recommended by buyer's inspector qualifies as a specialist. Seller gave buyer authority to bring the contractor into seller's home during the first 15 days of this inspection contingency without any additional permissions from seller or listing broker when seller agreed to the Form 35 with a 15 day inspection contingency. If LB continues to prohibit buyer from conducting buyer's inspections, broker should seek the assistance of broker's managing broker and if broker's managing broker cannot persuade listing broker and seller to adhere to seller's existing contractual agreement, then broker should advise buyer to seek legal counsel.
