DOL Application Period Extended: Investigations Supervisor (INV4)

The Department of Licensing's Centralized Investigations & Audits Unit (CIAU) has extended the recruiting period for an Investigations Supervisor (INV4).

This position oversees investigations of consumer or department complaints related to real estate brokers, managing brokers, firms, appraisers, home inspectors, notaries, and numerous other professions with a connection to real property.

Question

Looking through past videos, just last year you did one on the topic of the Financing Contingency surviving the closing date..... My understanding is that the financing contingency no longer survives closing and notice of inability to obtain financing must be given before the closing date. True?

Answer

Broker is correct. The Financing Contingency Addendum, Form 22A, was revised on February 24, 2026. Among the revisions to the form, the "survival" clause was eliminated. The result of this is two fold. Any buyer with the protection of the financing contingency must notify seller, not later than the scheduled day of closing, that the sale will fail because of buyer's inability to obtain financing and buyer's lender letter, required by Form 22A, paragraph 4, must be delivered to seller not later than 20 days following the notice of termination in order for buyer to recover the earnest money. This is a significant change to the financing addendum. Every broker who uses the statewide forms must take note of this change. It will change the way in which Form 22A is used by buyers and sellers alike.
