Question
Form 22a and Form 22b are both used in a transaction: The Form 22A Notice to Perform is delivered by the seller, but the Form 22B contingency to sell the property has not expired and there is no sale yet. What happens if the buyer waives their financing, but is unable to sell their house? Does the Buyer get their EM back because they were protected with the Form 22B home sale contingency? I assume the buyer would remain protected under the Form 22B.

Answer
Broker is correct. Waiver of buyer's financing contingency under Form 22A has no impact on the viability of buyer's home sale contingency under Form 22B. Based on the facts given, buyer's home sale contingency is still in effect after waiver of buyer's financing contingency.
