Question
When I am the BB, using the 22Q in my buyer's offer because my buyer has a pending sale but the pending sale has a home sale contingency, how would I determine a closing date? We are talking about my buyer making an offer on a home, while his home is currently pending, contingent on the sale of his buyer's home.

Answer
Broker's question is a good one and recognizes that when broker is using Form 22Q, the closing date of the transaction will be the date of closing identified on the face of Form 21 rather than by a calculation based on the closing date of the pending sale. For that reason, buyer and buyer broker should consider the latest possible closing date for buyer's pending sale based on the time remaining on buyer's buyer's home sale contingency plus 45 days for closing of a sale once buyer's buyer is found, and probably a few extra days for wiggle room.
Depending on the time remaining on buyer's home sale contingency, that could create a long closing period so buyer broker should be prepared to explain the length of the closing period to listing broker and a willingness on buyer's part to negotiate an earlier closing date if buyer's pending sale closes sooner. Moreover, buyer must recognize that if seller agrees to the closing date proposed in buyer's offer and then buyer's home sale closes much sooner, seller cannot be obligated to advance the closing date so there could be a gap of time between when buyer's home sale closes and buyer's purchase of seller's home closes.
