From the Attorney General’s Office: Landlord Obligations Under Washington’s Rent Stabilization Law
Washington’s new rent stabilization law (HB 1217), effective May 7, 2025, places limits on rent increases, requires extended notice periods, and adds new rules for leases, deposits, and late fees. These changes directly affect landlords, tenants, and investors, making it essential for REALTORS® to understand how the law impacts rental transactions and property management discussions with clients.

Question
I wanted to ask you a question regarding the Form 27 and Form 27CIC. Broker represents the buyers. She discovered by calling the HOA that they are a common interest community. Broker sent over the Form 27CIC to be filled out and instead of filling it out they emailed a Form 27 Resale Certificate statement and all the attached documents that were asked for in the P&S. She asked several times if they could also fill out the Form 27CIC but they said what they had was all they needed to send according to their own attorney.
I suggested that she respond to the form and have buyer initial and date if they are comfortable with the statement so at least we have something on file and to take detailed notes for the file of all her efforts to get it filled out. Do you have any other suggestions for next time? The HOA said they would not know how to answer the questions on the Form 27CIC. They are an old fashioned HOA with no professional management company.

Answer
It would seem buyer broker has done all that she can. Her job is to represent the buyers and in that regard, she has advised the buyers that they did not receive the disclosure form they should have received, she has provided them a blank copy of the form they should have received, she has presumably advised buyers that they have the right to terminate the PSA until closing based on seller's delivery of the wrong resale certificate and she has allowed buyer to instruct her as to how they want to proceed. In the mix of all that, BB should have and likely did also advise buyer to seek legal counsel if buyer has any questions about the significance of these events or how buyer should proceed. All of these conversations have been documented for retention in the firm's transaction folder. This is exactly what buyer broker should have done in this situation.
Unfortunately, it is not uncommon for HOAs to provide the wrong resale certificate. There is a case that was delivered in early May 2025, from the appellate court, however, that addressed liability for HOAs that fail to properly comply with their obligations regarding delivery of a resale certificate. (Parisien v. Eighty South Jackson, docket number 40267-3.) If the failure of an HOA to properly deliver resale certificates results in damages to a buyer or a seller, it is likely that more and more HOAs are going to find themselves defending lawsuits and learning, in a painful way, the importance of complying with the law regarding resale certificates.
