Question
Our listing. Mutual acceptance with 5 days to make loan application. Buyer made application with lender who had given a prequalification letter. Twelve days after mutual acceptance, a low appraisal is received. Buyer had changed lenders and applied to that company, still within the 5 day window following mutual acceptance. Does seller have a case to say buyer that waived the financing contingency based on buyer's change of lender without approval of seller. First lender had already sent disclosure documents.

Answer
No. Unless seller and listing broker created a special provision in the PSA obligating buyer to use the lender who authored the pre-approval letter, then buyer was free to make loan application with any lender of buyer's choosing, so long as application was made within five days following mutual acceptance. It appears that happened in this transaction. With that, there is nothing provided in the facts indicating that buyer waived buyer's financing contingency. Nothing in the boilerplate language of the statewide forms obligates a buyer to use the lender who drafted the buyer's pre-approval letter.
