Question

We have just had an offer accepted and buyer is in the 10 day inspection window. We were served with a bump notice three days after buyer's offer was accepted. I need to double check and see if the 10 day window for inspection period takes priority or if the 5 day bump notice contingency trumps the inspection time frame? This is a first for me and I don’t see anything on either form that addresses what happens in this scenario.

Answer

The two time periods are independent. Neither trumps the other because they run independently and, in this case, simultaneously. Buyer's inspection contingency time period began to run at mutual acceptance. During buyer's inspection contingency, seller has the right to deliver a bump notice to this Form 22B buyer. Once the bump notice is delivered, buyer's bump period begins to run. When this happens, buyer's inspection contingency and bump period will run simultaneously. If the bump period ends prior to waiver or satisfaction of the inspection contingency, then buyer will have to address the requirements of the bump notice even if the buyer's inspection contingency requests have not been fully negotiated.
