Question
If you already have a BBSA signed with a buyer and they want to go see a listing that you just put on the market where the sellers do not want you to be a limited dual agent, I am assuming you have to refer that buyer to another agent without showing them the property, and specifically do not show them that property?
|
Answer
Broker is correct. Showing the property to the buyer is the provision of RE Brokerage Services. If broker shows this property to this buyer, broker will do so as the agent for the buyer and as the agent for the seller. Broker's representation of both buyer and seller will conflict with seller's agency agreement and will violate Washington's Agency Law. Broker must refer the buyer to another broker without showing the property to the buyer or broker must decline the listing and represent buyer instead of seller.
